Analysis: The grounds supplied to the detenu were found to be substantially the same as the remand application submitted by the revenue intelligence officers, with only minor changes. The grounds did not clearly and specifically convey the allegations against the detenu and instead mechanically reproduced the contents of the remand request. Preventive detention requires an informed and genuine satisfaction of the detaining authority, and such mechanical copying indicates absence of independent application of mind.
Conclusion: The detention order was vitiated on account of non-application of mind and could not be sustained.
Issue (ii): Whether the detention order was invalid due to undue and unexplained delay in execution, destroying the nexus between the alleged activity and the preventive purpose.
Analysis: The order remained unexecuted for more than eleven months. The explanation offered for the delay was found unsatisfactory and vague. Reliance on summons under the Customs Act did not explain the delay in serving the detention warrant, and no proper resort was shown to the procedure for execution of warrants or to the statutory mechanism applicable where the detenu is said to be absconding. In preventive detention matters, unexplained delay in execution may show that the live link between the grounds and the detention purpose has snapped.
Conclusion: The detention order was invalid for undue and unexplained delay in execution and absence of a live nexus with the preventive object.
Final Conclusion: The preventive detention could not be sustained, and the detenu was directed to be released forthwith unless required in any other matter.
Ratio Decidendi: Preventive detention is unsustainable where the grounds are mechanically copied without independent application of mind and the detention order is executed after unexplained delay that breaks the live nexus with the preventive purpose.
