Issues: Whether the applicant was entitled to waiver of pre-deposit in view of the claim that transportation of mushrooms fell within the exemption for vegetables under Notification No. 33/2004-ST.
Analysis: The adjudicating authority had allowed the benefit of the notification on the basis that mushrooms were covered as vegetables under the relevant tariff classification. On perusal of that order, the Tribunal accepted the classification basis adopted by the adjudicating authority and found the original view correct for the purpose of interim relief.
Conclusion: The applicant was entitled to waiver of pre-deposit and the stay petition was allowed.
Final Conclusion: Interim relief was granted by accepting the assessee's entitlement to the notification-based exemption at the stage of pre-deposit.
Ratio Decidendi: Where the classification adopted by the adjudicating authority supports coverage under the exemption notification, pre-deposit may be waived pending disposal of the appeal.
