Political Figure's Bail Condition Upheld; Ban on Political Activity Stays Amid Law and Order Concerns.
The HC declined to modify the bail condition prohibiting the Petitioner, a political figure, from engaging in political activities. Despite the ... Interim application - Prayer for modification of prayer imposed, while directing to release of the Appellant on bail - it was directed that Appellant shall not create any untoward situation in public and shall not be involved in any political activities, directly or indirectly - HELD THAT:- It needs to be mentioned here that according to the allegations made against the Appellant he was involved in 57 cases earlier. Upon hearing both parties and considering present situation as it remains a fact that he was not only involved in other cases but also murderous attempt was made upon him, it would be unjustified to modify the condition of the bail permitting the Appellant to take part in political activities which would be in further deterrence of law and order situation in the locality involving the Appellant. As such, this Court is not inclined to modify the condition as prayed for and accordingly the interim applications are rejected. Issues Involved: Modification of bail condition for political activities.Summary:The matter was taken up through Hybrid mode, with the Petitioner's Senior Counsel requesting modification of a condition imposed in a previous order for the release on bail. The condition prohibited the Appellant from engaging in any political activities. The Petitioner, a political figure and former Mayor, sought permission to participate in political activities due to the upcoming general election. However, the State objected, citing new criminal cases and a recent murderous attempt on the Petitioner. The objection affidavit detailed the incidents and highlighted the ongoing investigations. The Court, after considering the arguments and the dangerous situation the Petitioner was involved in, declined to modify the bail condition. It was deemed that allowing the Petitioner to engage in political activities could worsen the law and order situation in the locality. Consequently, the interim applications for modification were rejected.
