Ex-parte order passed by Tribunal - As assessee was confused to note down the date of next hearing in Virtual Mode and due to which the non-appearance on behalf of the assessee was caused before this Tribunal and submitted that assessee is ready to prosecute his appeal if this Tribunal pleased to recall the ex-parte order - HELD THAT:- Revenue did not report the objection in recalling the exparte order, therefore, considering the facts and circumstances of the case, in the interest of justice, we deem it proper to recall the order and direct the registry to fix the appeal in regular course. MA of assessee allowed. The Appellate Tribunal ITAT Pune allowed the Miscellaneous Application of the assessee to recall the ex-parte order dated 17.06.2021 in Appeal No.1869/PUN/2018. The order was recalled in the interest of justice, and the appeal will now be fixed in the regular course. The order was pronounced in open court on 23rd May, 2022.
