Issues: Whether the Letters Patent appeals were barred by limitation after the filing and disposal of review petitions before the learned Single Judge.
Analysis: The delay in moving the review petitions before the learned Single Judge was competent to be condoned by that court. Once the review proceedings were entertained and decided, the entire period from the original judgment till disposal of the review petitions had to be excluded while computing limitation for the Letters Patent appeals. On that computation, the appeals were within time; in any event, the delay stood sufficiently explained.
Conclusion: The appeals were not time-barred and the High Court was required to entertain them and decide them on merits.
