Issue (i): Whether the rent decrees obtained against the registered pattadar and the transferees could be executed against the suit lands under Section 147 of the Estates Land Act.
Analysis: The landlord had treated Guruvamma as the registered pattadar for the whole holding with the knowledge and apparent consent of the persons interested in the estate. The transferees under the later sale had notice of the rent liability, and their failure to take steps to secure registry in their own names did not absolve the property from the landlord's claims. The statutory protection in Section 147 did not assist them in the circumstances so as to defeat execution of the decrees.
Conclusion: The decrees could be executed, and the appellant was entitled to execute not only Exs. II, II-A and II-E, but also Exs. II-B, II-C and II-D.
Issue (ii): Whether the mortgagee's rights under the earlier mortgage could be enforced only subject to the landholder's charge for rent under Section 125 of the Estates Land Act.
Analysis: The earlier mortgage was not extinguished merely because a later mortgage and decree existed on the same property. The statutory rent charge created by Section 125 had priority, and the landholder was not required to be impleaded as a party in the mortgage suit. The later events during the pendency of the litigation also justified moulding relief so that the respective rights could be worked out without further disputes.
Conclusion: The mortgagee's rights remained subject to the landholder's charge to the extent of the amount due under Ex. A.
Final Conclusion: The appeal succeeded in part by enlarging the executable decrees in favour of the landlord, but the mortgage rights were preserved only subject to the statutory rent charge, and the matter was remitted for working out the parties' rights.
Ratio Decidendi: Where the landlord bona fide treats a person in possession as the registered pattadar with the knowledge of the interested parties, transferees who stand by cannot later defeat the landlord's rent decrees, and a mortgagee's rights in ryoti land remain subject to the statutory charge for rent under the Estates Land Act.
