Issue (i): Whether the assessee was entitled to modvat credit on the strength of duty-paying documents.
Analysis: The credit was claimed in respect of periods for which monthly returns had been filed and the relevant invoices were stated to have been submitted along with the returns. The record did not show that the department had recorded any contemporaneous objection to the availability or verification of the duty-paying documents when the returns were scrutinised. In these circumstances, the subsequent objection at the audit stage did not establish that credit had been taken without valid documents.
Conclusion: The credit was held to be admissible and the demand and penalty could not be sustained on merits.
Issue (ii): Whether the demand was barred by limitation and the extended period could be invoked.
Analysis: The relevant periods were 1997 to 1999, while the notice was issued much later. The monthly returns had been filed in time, and the department was already aware of the material facts relating to availment of credit. In the absence of a proved case of suppression, misstatement, fraud, or intent to evade duty, the extended period was not available.
Conclusion: The demand was held to be time-barred and invocation of the extended period was rejected.
Final Conclusion: The Revenue's challenge failed, and the order granting relief to the assessee was sustained.
Ratio Decidendi: Modvat credit cannot be denied where the relevant duty-paying documents were furnished and scrutinised in the ordinary course, and the extended period under the excise law is unavailable unless suppression, misstatement, fraud, or intent to evade duty is established.
