of <h1>Appellate Tribunal directs file reconstruction, halts recovery, requests documents for final hearing</h1> The Appellate Tribunal CESTAT Mumbai ordered the Registry to reconstruct the appeal file and instructed the Revenue not to take coercive recovery steps ... Recovery proceedings of remaining amounts - appeal pending before the Tribunal - appellant made a pre-deposit of Rs.2,00,000/- at the time of adjudication - as mentioned under the column Probable date of Posting where the Registry has given comments: that Appeal papers weeded out on 01.08.2000 & appeal file to be reconstructed - Held that:- As the Registry is directed to place the matter before the Hon'ble Vice President/HOD for approval for the reconstruction of the appeal file Revenue is also directed that till such time not to take coercive steps to recover the proceedings against the impugned order. The Appellate Tribunal CESTAT Mumbai directed the Registry to reconstruct the appeal file pending before them. The Revenue was instructed not to take coercive steps for recovery until the file is reconstructed. The Counsel was asked to provide relevant papers for final hearing once the file is reconstructed.
