Apparent from the facts and circumstance of the case appeal is allowed and the cost on two officers had been waived. 0rder of the High Court is set aside. The Supreme Court of India allowed an appeal by the Union of India, waiving costs imposed on two officers by the High Court. The appeal was represented by various advocates. Shri S.K. Bagaria accepted notice for the respondent. Leave was granted, and after hearing both parties, the costs were waived based on the fairness of the respondent's counsel's statement.
