Issues: Whether a preventive detention order under the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974 could be successfully challenged at the pre-execution stage on the ground that the live link between the prejudicial activity and the detention order had become stale or lost by passage of time.
Analysis: The detention order was issued in relation to alleged smuggling-related activities and remained unexecuted because the proposed detenu was outside India. The challenge was examined in the light of the limited grounds available for pre-execution interference and the statutory scheme enabling action under Section 7 of the Act when execution is being evaded. The delay between the alleged prejudicial acts, the sponsoring authority's recommendation, and the detention order was found not by itself sufficient to conclude that the order had become stale. In matters involving cross-border and multinational smuggling activity, the passage of time and non-availability of the proposed detenu within India do not automatically destroy the live link or render the detention order unenforceable.
Conclusion: The pre-execution challenge failed and the detention order was held not liable to be annulled on the ground of delay or loss of live link.
Final Conclusion: The writ petition was dismissed and the preventive detention order was left undisturbed.
Ratio Decidendi: A preventive detention order challenged before execution will not be invalidated merely because of lapse of time where the prejudicial activity is continuing in nature or has cross-border dimensions, and the delay in execution is attributable to the proposed detenu's absence from the jurisdiction.
