Issues: Whether, under Rule 51(A) of Chapter XIV-A of the Kerala Education Rules, a teacher who was earlier relieved from a temporary vacancy had a preferential right to appointment to a later permanent vacancy over another qualified teacher who had served later in the same school.
Analysis: Rule 51(A) confers preference on qualified teachers relieved on account of termination of vacancies for future vacancies in schools under the same educational agency. The preference is not left to the manager's unrestricted choice between rival claimants. The note appended to the Rule clarifies that where there is more than one claimant, preference follows the date of first appointment, and where that is the same, age governs. On the facts, both teachers were eligible, both had been relieved for termination of vacancies, and the appellant had earlier service. In the absence of abandonment or disqualification, the proper construction of the Rule required preference to be given to the earlier appointee.
Conclusion: The appellant had the superior claim to the vacancy and was entitled to appointment in preference to the later claimant.
