Issues: Whether the appellant was entitled to waiver of pre-deposit and stay of recovery pending appeal in a dispute concerning classification of Magnesium Sulphate and eligibility to concessional duty under Notification No. 1/2011-C.E.
Analysis: The dispute turned on whether the product, admittedly used as fertilizer, could obtain the benefit of the notification when the department had reclassified it from Chapter 31 to Chapter 28.
