When this stay petition was called, both the sides agree that the issue is regarding differential Customs duty on the goods imported, i.e. steam coal and that issue is referred to Larger Bench in the case of Tamil Nadu Generation and Distribution Corporation Ltd., (TANGEDCO). - Stay granted. The Appellate Tribunal CESTAT Mumbai allowed the stay application for waiver of pre-deposit and recovery of differential Customs duty on imported steam coal until the appeal is disposed of. The issue was referred to a Larger Bench following a convention.
