Issue (i): Whether confiscation of the imported used pipes was warranted under the Foreign Trade Policy.
Analysis: The goods were imported as used pipes without a licence. The policy provision relied on permitted free import of second hand capital goods, including refurbished or reconditioned spares, and the Tribunal held that the import did not fall outside the policy bar in the manner urged by the appellant. The challenge to confiscation therefore did not succeed.
