Issues: Whether, under Rule 26 of the Orissa Service of Engineers Rules, 1941, direct recruits to the post of Assistant Engineer were to be treated as recruits of the year in which the vacancy arose or of the year in which the appointment order was issued, for the purpose of inter se seniority with promotees.
Analysis: The scheme of the Rules showed that recruitment to the cadre of Assistant Engineer was complete only upon final selection by the State Government and issuance of appointment orders. Rule 26 used the expression that officers are recruited by promotion and by direct recruitment during the same year, and the Court held that the expression had to be given its ordinary meaning. The quota provisions governing recruitment could not be engrafted into the seniority rule in the absence of such language. The year of occurrence of vacancies was held to be irrelevant for seniority under Rule 26, and the crucial date was the year of actual appointment into service.
Conclusion: Direct recruits appointed in 1980 could not claim seniority as recruits of 1978. Promotees appointed during the same calendar year were senior under Rule 26. The challenge to the Tribunal's view failed.
Ratio Decidendi: Where a seniority rule fixes inter se seniority by reference to recruitment during the same year, the decisive factor is the date of actual appointment on final selection, not the year in which the vacancy arose, and quota provisions cannot be imported into the seniority rule unless the rule expressly so provides.
