Versus COMMISSIONER OF CENTRAL EXCISE, VAPI - 2009 (234) E.L.T. 77 (Tri. - Ahmd.), 2010 (18) S.T.R. 538 (Tri. - Ahmd.) The Appellate Tribunal CESTAT, Ahmedabad, in the case of Ms. Archana Wadhwa v. Shri B.S.V. Murthy, noted that the earlier order against the appellant was set aside by the Hon'ble High Court of Bombay. The matter was remanded to the Tribunal for a fresh decision. The Tribunal scheduled the appeal for disposal on 19-2-2009 to decide whether Education Cess is required to be paid by a 100% EOU for clearances in DTA.
