Issues: Whether the appellants made out a strong prima facie case for total waiver of pre-deposit in a dispute concerning valuation and the claim to exemption under Notification No. 6/2002-C.E. dated 1-3-2002.
Analysis: The dispute was not one of classification. The claimed exemption required exclusion of the value of the chassis falling under Heading 87.06, but the running gear was found prima facie not to be chassis under that heading. The authorities relied on by the appellants were held to be prima facie inapplicable because they concerned classification, whereas the present controversy concerned valuation and eligibility to the notification benefit.
