EX., BHUBANESWAR-I</h3> COSBOARD INDUSTRIES LTD. Versus COMMISSIONER OF C. EX., BHUBANESWAR-I - 2005 (181) E.L.T. 208 (Tri. - Kolkata) The Appellate Tribunal CESTAT, Kolkata dismissed a stay petition for the realisation of disputed duty as the tribunal had become functus officio after passing a final order. The request for stay was made pending a Reference Application before the High Court of Orissa. The Tribunal did not have jurisdiction to modify its own order or entertain the request. The stay petition was accordingly dismissed.
