Issues: Whether A.C. sheets, fire-proof doors and air-conditioners used in a 100% export-oriented unit were eligible for exemption under Notification No. 123/81 as goods used in connection with manufacture, and whether the remaining disputed items were likewise eligible.
Analysis: The items had to be tested against the notification requirement that the goods be capital goods, components, raw materials, spares or packaging materials used in connection with manufacture and packaging. On the facts shown, A.C. sheets used for factory sheds, fire-proof doors installed in manufacturing departments, and five air-conditioners used in the R&D section for operating testing machines had a sufficient nexus with manufacture of filament yarn. By contrast, syntex water tanks were not shown to be used for manufacture of filament yarn, and the remaining office equipment and similar items were not capable of being treated as goods used in connection with manufacture.
Conclusion: Exemption was allowed for A.C. sheets, fire-proof doors and five air-conditioners, and denied for the syntex water tanks and the office-equipment items.
Final Conclusion: The duty demand had to be recomputed on the basis of partial exemption, and the penalty stood reduced accordingly.
Ratio Decidendi: Goods have a sufficient nexus with manufacture for exemption purposes when they are used in the manufacturing process or in activities integrally connected with production, but not when they are merely office equipment or items without a demonstrated manufacturing nexus.
