Issues: Whether the applicants were entitled to complete waiver of pre-deposit in respect of central excise duty and penalties, and whether the goods in question prima facie fell within the scope of the exemption notification.
Analysis: The exemption notification covered only wheels and axles of animal-drawn vehicles. On a prima facie view, hubs did not fall within the notified items and could not be treated as a part of the wheel for claiming the exemption. The applicants therefore did not establish a strong prima facie case for total waiver. Their financial position was, however, taken into account while determining the quantum of pre-deposit.
Conclusion: Complete waiver was declined. The applicant company was directed to deposit a part of the duty demand, with waiver of the balance amount of duty and the entire penalties upon compliance, and recovery of the remaining amounts was stayed during pendency of the appeals.
Final Conclusion: Interim relief was granted only in part, and the matter was kept pending subject to compliance with the directed pre-deposit.
