Issues: Whether the shortage of inputs found in subsequent stock verification could be assessed on the basis of the original balance in RG 23A Part I, despite an earlier shortfall having attained finality and requiring reduction of the opening balance.
Analysis: The earlier shortfall of 6232.156 MT of alumina had already been settled under the Kar Vivad Samadhan Scheme, and the effect of such settlement was that the earlier denial of Modvat credit became final. Consequently, the starting balance in RG 23A Part I had to be treated as reduced by that quantity for later stock reconciliations. The same principle applied to the subsequent period also, because an incorrect opening balance would necessarily distort the later shortage calculation. The Commissioner (Appeals) correctly followed the earlier Tribunal order and directed verification and neutralisation of the short found quantity.
