Issues: Whether the length of galleries of a hot air stenter is to be included while computing annual production capacity under the Hot Air Stenter Independent Textile Processors Annual Capacity Determination Rules, 1998, as amended by Notification No. 14/2000-C.E. dated 01.03.2000.
Analysis: The dispute turned on the correct method of computing annual capacity for hot air stenters. The applicable amended rules and the explanation thereto were considered in the light of the Larger Bench decision, which held that galleries are not part of the equipment actually aiding the process of heat setting or drying of fabrics. On that basis, the galleries were treated as outside the computation base for determining production capacity.
Conclusion: The length of galleries of the hot air stenter is not to be taken into account for computing annual production capacity.
Final Conclusion: The revenue appeals failed and the order excluding gallery length from capacity computation stood affirmed.
Ratio Decidendi: For annual capacity determination of a hot air stenter, only the components that directly aid the process of heat setting or drying are includible, and gallery length is excluded.
