ITAT website e-notice board timely display is desired for all relevant information. Information displayed just few days ago generally and in some cases long before and or longer duration shows scope of improvement in working of ITAT.

Website of ITAT is very informative and useful. Over years it has implemented many improvements about content and search facilities. However, it is only instrument for information display and is dependent on various department and branches of ITAT. However, some good features in search have been discontinues or modified resulting into difficulty in search with name or part of names for search of group or type of assesses. For example, author recall search of orders with industry specific search for sugar, steel, textiles etc. in which names of various cases in which particular word appeared and earlier search was for all benches. This was discontinued. However, now we can search with part of name like sugar, or tea or steel but it will be for appeal type and bench wise. An all India search (for all benches) can be introduced.

Important information are:

Constitution of benches and revision in constitution - many times constitution is displayed early and then cause lists are displayed separately.

Sometimes constitution and cause list are displayed at the same time. In some cases we also noticed that constitution was placed earlier then again constitution and cause list is displayed at same time.

Cause list- cause list is very important because there can be cases when we get notice only through e-notice board. This happens, in particular when case was fixed and notice was issued in paper mode, Then on adjournment, notice may be issued only through the notice board.

Pronouncement list- Pronouncement list is also very important, because in some circles, pronouncement date can be considered as beginning point of time to count limitation period for further appeal. It may be presumed that on pronouncement, the parties are conveyed about the order / judgment, and therefore, they must be on high alert, if an appeal is intended to be filed.

Upload date is given, time is not given:

We find that only date of uploading is given, time of uploading is not given. Time of uploading is an important factor, when notice is uploaded just one or two days before the hearing or pronouncement.

For example, in document no. 1 on first few pages we find that most of documents are uploaded on 16.04.26 and the case is fixed on 17.04.26. This is common in case of Friday cause list, that is for Miscellaneous Applications (MA), Stay Petitions (SP), clubbing requests, Pronouncement lists, etc.

In case of other days also we find that in many cases notice is displayed just few( 1-3) days ago.

Longer duration is available only about constitution (with or without cause list)

When constitution for few days (Maximum four days i.e. Monday to Thursday) is displayed. For example:

We find that in only few cases constitution for longer duration is published well in advance. For example:

This shows that it is possible to decide constitution and cause list both for longer duration also. Whereas we find that in most of cases constitution is uploaded for first four days of week and for Friday separately.

Timely and final information is desirable

Timely and final information will help taxpayers and their representative to plan representation before ITAT and comply with well in advance.

Very short notice and frequent changes in dates of hearing causes difficulties.

Adjournment of bench, cancellation of bench also creates difficulties. Particularly when people has to come from outstations.

Delayed display of information about cases fixed on next day causes lot of difficulty.

For example, author faced few times adjournment of case just at the office of Tribunal in other city when he reached the Tribunal located in other city and found that the bench was not functioning. For such reasons, author choose not to take outstation assignment for representation.

At 8.40 PM on Thursday / 16.04.26 there is no information about cause list on the portal for Friday 17.04.26 of ITAT, Kolkata Bench. The latest information on search for Kolkata is

May be when we go to Tribunal tomorrow, then after waiting for some time we may get information that the particular bench is not functioning. Similar situation takes place, many times.

This keep tax payers and their representative and also the Departmental Representatives in a difficult situation. This write-up may be useful to examine similar aspects of other courts and Tribunals. Hence this is market as other topic.
