Supreme Court Appeals: 30th Amendment Act Preserves Pending Cases While Applying New Rules to Future Civil Proceedings
This provision of the Constitution (30th Amendment) Act, 1972 addresses pending appeals before the Supreme Court during the transition period. Appeals pending before the Act's commencement under Article 133(1)(a), (b), or (c), and appeals filed after commencement based on certificates issued by High Courts before commencement, remain unaffected and may proceed as if the Act had not been passed. However, all other appeals to the Supreme Court from civil proceedings instituted before the Act's commencement must satisfy the amended provisions of Article 133(1). The Act came into force on February 27, 1973.
