Inspectors must give employers a thirty-day opportunity to comply before prosecuting offences under the Code, except in cases of accidents or repeat violations within three years; courts lack cognizance unless the Inspector cum Facilitator files a complaint within six months of knowledge, and only courts not inferior to a Metropolitan Magistrate or Judicial Magistrate of the First Class may try such offences. Limitation for continuing offences is measured at each point the offence continues, and extensions granted to employers shift the computation start to the expiry of the extended time.
