Abatement of appeals: death ordinarily terminates appeals, but near relatives can seek leave to continue serious convictions.

Every appeal under specified provisions finally abates on the death of the accused, and other appeals (except appeals from sentences of fine) abate on the death of the appellant. If an appeal challenges a conviction and sentence of death or imprisonment and the appellant dies during pendency, a "near relative" (parent, spouse, lineal descendant, brother or sister) may apply within thirty days for leave to continue the appeal; if leave is granted the appeal does not abate.
