The amendment substitutes subsection (8) to make the company and every officer in default liable to a fixed initial penalty and, for continuing failures, a further daily penalty after the first day, subject to a specified maximum aggregate cap; it thus imposes concurrent corporate and officer liability and quantifies both one-off and continuing monetary sanctions.
