Since the total income returned by the assessee was less than 80 per cent of the total income assessed, the ITO thought that this is a fit case for levy of which the particulars have been concealed or inaccurate particulars have been furnished amounted to Rs. 18,280 according to the ITO. The Explanations raised a legal fiction and the assessee was brought straight away within the ambit of the said provision. This legal fiction of the Explanation could, however, be displaced if the assessee proves that failure to return the correct income did not arise out of any fraud or gross or wilful neglect on his part.
