Once an order has been passed, whether it is legal or not the same has to be challenged in the higher appellate forum. Merely by saying that the duty has been paid by them under protest will not make such an order a non appealable order. We also observe that the first letter addressed by them to the department requesting for passing a speaking order was sent much after the period of limitation specified in Section 128 of the Customs Act for filing appeal had expired.
