Cheminocel was classified under CTH 3101, reinforcing the classification of nutrient-based plant growth promoters as fertilisers. 9.4 Furthermore, reliance is also on the case of Leeds Kem vs. Commissioner of C. Ex., Aurangabad (2001 (134) E.L.T. 294 (Tri. - Del.)). In the said case, the product "Plantozyme" - a bio fertiliser made from hydrolyzed milk proteins and seaweed extract, was classified under CTH 3101 despite containing small amounts of cytokinins (plant growth hormones). It was ruled that mere presence of trace growth-promoting substances does not turn a fertiliser into a plant growth regulator under CTH 3808, as fertilisers are meant to supply essential nutrients rather than regulate plant metabolism. Rahul Sinha and Ashwin Pahwa, authorized representative appeared for PH in the matter from the applicant side. Regulation of plant biostimulants The regulatory situation of biostimulants is very complex today, in the absence of any specific and harmonized framework in either the EU or the USA.
