.... valued at Rs. 35,66,154/- were recovered by officers of DRI, Varanasi Zonal Unit from the Appellant. This fact was also confirmed by the Appellant in his statement dated 14.02.2022 recorded under Section 108 of the Customs Act, 1962 wherein he revealed that the said gold biscuits were smuggled into India from Bangladesh through off routes via Malda and being the smuggled goods, no documents in relation to the said goods were available with him. He further stated that he received the said foreign origin gold from a person namely, Shri Biplab Chaudhary on cash payment of Rs. 34 lakhs at Malda, which he was going to sell at Pratapgarh for Rs. 35,66,154/-. He admitted that he did not have any valid document with respect to purchase of the said recovered gold. 5.3 It has been held in catena of judgments that the statements recorded under Section 108 of the Act are in the nature of substantive evidence and culpability of the offence by the concerned persons can very much be relied upon on such statement. ....his statement. It, thus, transpires that the Appellant was found to have committed an offense which would make him liable to penalty under Section 112 (b) of the Customs Act, 1962. Thus, the original adjudicating authority has correctly penalized the Appellant and keeping in mind overall facts of the case, I find that the quantum of penalty is just and appropriate and I do not wish to interfere with that. 5.5 The appeal filed by the Appellant is rejected accordingly upholding the Order- in-Original as legal and proper. 2.1 The Appellant was intercepted on 14.02.2022 in presence of Panchas by the Officers of DRI, Varanasi Zonal Unit at Varanasi Railway Station on the basis of specific intelligence received by them. On inquiry, Appellant admitted to be in possession of 06 pieces of gold of foreign origin. 2.2 Thereafter he along with the panchas came to the office of DRI wherein search was conducted by the officers resulting in recovery of 06 pieces of foreign origin gold biscuits of 999.9 purity having mark 'SUISSE, 10 TOLAS, FINE GOLD' each weighing 116.540 gms concealed in the waist belt worn by the Appellant. 2.3 As all the proceedings from interception ....

We are in agreement that the submissions made with regards to the non-voluntary nature of the statement for the very reason that the statement was recorded late in the night starting from 2100 Hrs to 0200 Hrs itself shows that it was recorded in duress. Further the contents of statement recorded in the statement on 14.02.2022 and the Panchnama dated 14.02.2022 are exactly identical. It is also evident that the panchnama proceedings which had started at 1230 Hrs had continue till 2030 Hrs and the statement was recorded immediately thereafter. The above gives the impression that panch witness were present during the interrogation of the Appellant. If they were present during the interrogation then they should have been asked to sign the statement also. 4.6 Immediately after being released on bail Appellant disputed the statement recorded on 14.02.2022 and retracted the same.
