CIT (A) has taken cognizance of the Explanation 1 to section 37 and in page 14 of his order, has categorically held that the disallowance u/s. 37 would only come into play if the assessee had been penalized under the appropriate sections of the respective statute and if the assessee has claimed this penalty as an expenses in the profit and loss account.
