It is submitted that the impugned order is sought to be supported by assigning different and supplementary reasons in the counter, which cannot be taken into account in view of the Constitution Bench Judgment of Supreme Court in Mohindhr Singh Gill and Another v. Chief Election Commissioner, New Delhi and others (1978) 1 Supreme Court Cases 405. 7.
