....acts of the case are that the appellant had filed a refund claim on 08.04.2009 claiming refund of export duty of Rs.50,25,500/- being the excess duty @ Rs.250/- per metric tonne paid at the time of export of Iron Ore under Shipping Bill No.100/07 dated 30.04.2007. The refund claim was though sanctioned by the adjudicating authority but directed to be credited to the Consumer Welfare Fund.
