Therefore, we hold that raising the issue of substantial expansion again by the Ld. Commissioner (Appeal) is bad in law which has attained finality. The Ld. Advocate fairly submits that the issue of eligibility of refund on account payment of Education cess and Higher Secondary Education Cess is against them in view of the decision of the Hon'ble Guwahati High Court and hence they have not appealed against this issue.
