In the cases before us, the assessment years with which we are concerned are 1967-68 and 1968-69. ....he counsel for the assessee maintained that entry 42 in the First Schedule to the General Sales Tax Act which was construed by the Division Bench and which we have quoted above is not ad idem with entry 24(4) of the Industries (Development and Regulation) Act, 1951, which has to be construed in the present case and that it would be wrong and dangerous to import into the consideration of the said entry things which are germane to the consideration of a different entry altogether. We are impressed by this reasoning of counsel for the assessee. It seems to us there is a fundamental difference between the nature and the content of entry 24(4) of the First Schedule in the Industries (Development and Regulation) Act with which we are concerned, a....
