....Kochi/assessee, is the appellant in both appeals. The Assistant Commissioner of Income Tax, Kochi/Revenue, is the respondent. ....f the Act, denying the consideration of the assessee's claim under Section 145A is equally erroneous and illegal. Firstly, he prays for setting aside the findings of the Tribunal as the findings are seriously flawed, and on assumptions, conclusions have been recorded and restored the findings recorded by the CIT (Appeals).
