M.A.T. No. 2027 of 2022 wherein Hon'ble Calcutta High Court held that "appellant being a registered dealer under provisions of the act could be an applicant under Section 95(c) of the Act". We have gone through the order passed by the Hon'ble High Court. We find that in the refereed case the facts and contents are different and not relevant to the case presented before us.
