While Ms. Asha Tiwari, learned APP for the State, opposes the suspension of the sentence since the appellant has been convicted under section 6 read with section 5(m) of the POSCO Act and has been sentenced to 10 years in prison, she does not dispute that the appellant is certainly in a medically vulnerable position in prison.
