The facts that lead to levy of penalty u/s 271(c) are stated in brief: The assessee is an individual and is a Doctor. He filed his return of income declaring a total income of Rs. 23.74 lakhs. The said Accountant has inadvertently included the sale consideration received on sale of land in the list of sundry creditors instead of crediting the same to the capital account of the assessee.
