.... disjunctive was accepted as a matter of principle. By my interpretation of this sub-section, the words sold and discarded are disjunctive and denote separate dealing with the above items. Therefore, in my view, the tribunal made an error of law in coming to the conclusion that "there was no evidence to prove that the items claimed to have been discarded and scrapped were actually sold by the assessee."
