On the question of waiver of penalty under Section 76 and 77 Learned DR submits that there is nothing on record to substantiate any of the claims of the appellant. Regarding financial hardships and accounting problems, etc., there is no case to invoke of provisions of Section 80. Therefore, the appeal may be rejected. 8.
