....also known as Aspirin) falls under Schedule W of the Drugs and Cosmetic Rules, 1945 and therefore, in view of Rule 96 (1) (i) B can be marked only under generic name. Accordingly, the appellant with effect from April 98 discontinued the use of the said device/monogram on the packing of the said medicament and started marketing the same under the generic name only, namely Acetyl Salicylic Acid with the abbreviation (acronym) thereof ASA written in bracket in simple capital letters. Accordingly, the appellant treated this medicament as other than patent or proprietary medicament and filed a classification declaration of such goods under Chapter Heading 3030.20 which attracts Nil rate of duty for some period and thereafter lower rate of duty as compared to rate applicable to patent or proprietary medicament falling under Chapter sub-heading No.3003.10. The case of the department is that after the word Acetyl Salicylic Acid with the abbreviation (acronym) mentioned i.e. (ASA) is brand name of the appellant, therefore, it falls under the category of P & P medicament and correctly classifiable under Chapter sub-heading 3003.10. ....1998 Delhi 126 wherein it was held that abbreviation if used in any generic name will remain as a generic and merely by using abbreviation, on such abbreviation no-one can have sole right. He further submits that the show-cause notice alleged that the abbreviation "ASA" is the trade name of the appellant whereas the adjudicating authority has gone beyond the scope of show-cause notice and also included that package bear the name 'GR' which is otherwise a house name and the product become branded. In this regard he submits that firstly the medicament was marketed as "Acetyl Salicylic Acid Tablets IP 50 MG (ASA)". The word 'GR' was mentioned with the name of the company i.e., German Remedies Ltd., which is nothing but a house name, the same is not a brand name. The word "GR" is not suffixed or prefixed with the name of the medicament appeared on package of the medicament. As regards the use of house name, the Hon'ble Supreme Court in the name of Astra Pharmaceuticals (P) Ltd - 1995 (75) ELT 214 (SC) held that house name does not amount to affixing the brand name, hence such medicament does not qualify as P & P medicament. The definition of P & P medicament, which is provided under Note (i) and (ii) of Chapter 30 of CETA reads as under: 2. ....t was using the name "Liv. 52" and the respondent was using" Liv-T". The issue for consideration was whether word "Liv" can be considered as brand name of "S.B.L Ltd". Consequently, the respondent Himalaya Drugs whether entitled to use the same name, i.e. "Liv-T". The Hon'ble Court held that Liv is an abbreviation of organ liver. Therefore, it is a generic name and cannot be claimed as a trade mark by a particular person. We find that the ratio of this judgement is applicable in the facts of the present case also. As per the observation made hereinabove, we are of the clear view that the name of the medicament, i.e. "Acetyl Salicylic Acid" Tablets IP 50 MG "(ASA)" is not a brand name and it is a generic name therefore, it does not fall under the definition of P & P medicament. Accordingly, classification claimed by the appellant as medicament other than P & P under Chapter Heading 3003.20 is held to be correct. Samples were fil- tered through a 0.45 μm pore size syringe filter and diluted with a solvent in ratio 1:100. Absorbance was measured and concentration calculated using equations obtained by exam- ination of stock solutions. For partition coefficient determining, the classical shake- flask method was used. Same buffers as ones in determining solubility were used as a polar phase. For an organic phase, chloroform was used.
