....er (Appeals). In the second appeal before the Tribunal, the issue was decided in favour of the assessee by the Tribunal by relying upon a decision of the Bombay High Court in the case of CIT v. West Coast Paper Mills Ltd. [1992] 193 ITR 349 While doing so, the Tribunal distinguished the decision of the Calcutta High Court in the case of Seth Chemical Works v. CIT [1983] 140 ITR 507. At the time of hearing, Mr. M.R.
