....it is now provided that the Appellate Tribunal constituted under sub-section (1) of Section 12 of Smugglers and Foreign Exchange Manipulators, (Forfeiture of Property) Act, 1976 (13 of 1976) (SAFEMA, for short) shall function as the Appellate Tribunal for hearing appeals against the order of the Adjudicating Authority and the other authorities under the PMLA. Pertinently, sub-section (6) of Section 12 of SAFEMA specifically provides for constitution of single Member or two Member Benches by the Chairman of the Appellate Tribunal and for such Benches to exercise the powers and functions of the Appellate Tribunal.
