Hon'ble Supreme Court in the case of Reliance Petro Products Ltd.(supra) has held that mere advancing of claim not sustainable in law does not ipso facto lead to levy of penalty. We, therefore, do not find any reason to interfere with the order of the ld. CIT(A). 10.
