The assessee claimed depreciation on goodwill. The case was selected for scrutiny assessment and the notice under Section 143(2) of the IT Act was issued. It is submitted that therefore it cannot be said that any error was committed by the Assessing Officer in assuming the jurisdiction to issue the impugned notice.
