The declared value was US $ 273 per MT CIF. However, the case was remanded to the Commissioner of Customs for the purpose of considering whether the appellant was entitled to the benefit of the proviso to Section (2) of Section 120 of Customs Act, 1962. Thereafter Commissioner of Customs vide order dated 6.6.2008 has confiscated 356.94 MTS of the goods of prime quality valued at Rs. 54,27,451/- under Section 111(m) of Customs Act, 1962 and imposed redemption fine of Rs. 3.75 lakh. Commissioner also imposed a penalty of Rs. 1.5 lakh on the appellant under Section 112(a) of the Customs Act, 1962.
