By showing less purchase price for chemicals which was ultimately sold to the ACL, the assessee has shown a higher profit, since otherwise, the profit earned by the assessee would have been less to that extent. He has come to the conclusion that the Assessing Officer has not established that the sale transactions of the appellant were sham one or that the appellant had sold the goods at a concessional rate to the benefit of ACL. He further observed that if at all any action was to be taken, it could be in the case of the ACL, but, there the Assessing Officer could not have made any addition because ACL is showing more profit.
