The second component of impugned demand relates to the amount received towards refundable loan which again is treated to be proceeds for providing support service of business or commerce. Notwithstanding ld. DR's support to the finding of the adjudicating authority, it is evident from the agreement dated 23.3.2009 that the appellants got interest free advance which was repayable. Indeed there is evidence of re-payment in the form of letters dated March to Feb 23.5.2013 showing repayment of two instalments . The adjudicating authority, prima facie, has not dealt with the appellants contention and has confirmed the impugned demand on the ground that they had not disclosed as to when the said amount was received by them and when they paid service tax on that amount.
